Draft — TODO-OPERATOR: set the effective date

1. Acceptance of Terms

By accessing and using mxtm.studio (“the Service”), operated by TODO-OPERATOR: legal entity / operator name, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Service Description

MXTM Studio provides a browser-based photo studio. Processing runs locally in your browser; your media never leaves your device. Actions explicitly marked as server-based (such as photo restoration or generative AI edits) transmit the image transiently to our AI provider for processing — see the Privacy Policy for details.

3. Free Use and Credits

• The editor is free of charge, without sign-up.
• Server-based AI actions include a limited free daily budget per device. Beyond that, they consume credits purchased via Stripe.
• Working across a whole roll of negatives (roll base, apply to strip, multi-image session files) requires the one-time license. Access to a purchased license does not expire; the included update window is 12 months and can be extended voluntarily.
• Credits never expire. They are bound to your device and can be restored on another device via the e-mail address used at checkout. Credits are non-transferable and cannot be redeemed for cash; a failed server action does not consume a credit.
• We reserve the right to modify, suspend, or discontinue any feature without prior notice.

4. Right of Withdrawal (EU consumers)

Credits are digital content delivered immediately after purchase. By purchasing, you expressly request immediate performance and acknowledge that you thereby lose your right of withdrawal (Art. 16(m) Directive 2011/83/EU and its national implementation — TODO-OPERATOR: confirm the national provision once the operator jurisdiction is fixed). Statutory rights for defective services remain unaffected.

5. Your Content

You retain all rights to the media you open and to all output produced by the Service. You confirm that you hold the necessary rights to the media you process and that you do not use the Service to process unlawful content.

6. Prohibited Use

You may not: reverse-engineer or decompile the Service; use automated systems to excessively access the Service or circumvent usage limits; or use the Service for any illegal purpose.

7. No Warranty

The Service is provided “as is” and “as available” without any warranties of any kind, whether express or implied. We do not guarantee the accuracy, reliability, or suitability of the features or AI results for any specific purpose. Mandatory statutory consumer rights remain unaffected.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Service. This does not limit liability for intent, gross negligence, or injury to life, body or health.

9. Intellectual Property

The website design, code, and branding are owned by TODO-OPERATOR: rights holder. All output produced by the Service belongs entirely to the user.

10. Governing Law

TODO-OPERATOR: governing law and place of jurisdiction (depends on the operating entity); mandatory consumer jurisdiction rules remain unaffected.
